The First 24 Hours

What Happens After an Arrest in Miami-Dade County

If someone you love was just arrested in Miami-Dade County, here is what is coming, fast.

1

First Appearance, within 24 hours

A judge reviews the arrest, sets or denies bond, and imposes release conditions like no-contact orders. A lawyer arguing for you here changes outcomes.

2

Bond & Getting Out

Bond can be paid in full or through a licensed bail bondsman (typically 10%). Getting out fast protects jobs, families, and the defense.

3

Filing Decision & Arraignment

The State Attorney decides what to formally charge. This window is where a defense lawyer can kill or reduce charges before they are filed.

DUI? You have 10 days. After a DUI arrest you have only 10 days to demand a DHSMV formal review hearing to fight your license suspension. Do not wait.

If Police Want to Talk to You

“I want my lawyer.” Then stop talking.
  • You have the right to remain silent. Use it. Explaining “your side” to police has never talked anyone out of an arrest.
  • Do not consent to searches of your car, your phone, or your home.
  • Be polite. Give your name. Nothing else.
  • Then call 1-833-STEVIE-1.
Straight Answers

Questions Families Ask at 3 AM

Why pay for a lawyer when the public defender is free?
Public defenders are real lawyers, and many are good ones. They are also carrying hundreds of cases at once. When you hire private counsel, you choose your lawyer, you can reach him directly, your family stays informed, and one lawyer handles the case from first appearance to the end, not whoever is covering the courtroom that day.
What happens in the first 24 hours?
First appearance happens within 24 hours of arrest: a judge reviews probable cause, sets or denies bond, and imposes conditions like no-contact orders. Having a lawyer arguing at first appearance can mean lower bond and conditions you can actually live with.
What is the DUI 10-day rule?
After a DUI arrest you have 10 days to demand a DHSMV formal review hearing to fight your driver license suspension. Miss it and the suspension takes effect automatically. This deadline is why you call a DUI lawyer the same week, not next month.
Can a domestic violence charge be sealed later?
No. DV battery is on Florida's disqualifying list, so it can never be sealed, even with adjudication withheld. The only clean outcome is winning, a drop, or an amendment to a non-DV charge. That is why fighting it now matters more than on almost any other misdemeanor.
The charges have not been filed yet. Should we wait?
No. Between arrest and the State Attorney's filing decision is the single best window for defense work. We present your side to the prosecutor and push for no charges, reduced charges, or a summons instead of a warrant. Pre-file representation is $1,500 and it is credited toward the felony fee if charges get filed.
How do the flat fees work?
The fee posted is the fee, based on your charges, record, and county, covering everything from hire through plea or dismissal. If the case is going to trial, trial is quoted separately before you commit to it. Court costs and filing fees are separate, like every law firm.
What if I can't pay all at once?
Most clients don't. We take all major cards, split fees into an in-house 4-payment plan, and offer a financing application (ClientCredit by Affirm) with 3 to 12 month terms. The lender makes the credit decision, not the firm, and we never see your application.
Do you handle federal cases?
Yes. Steven C. Fraser is admitted in the Middle, Northern, and Southern Districts of Florida and the District of Columbia. Federal cases are quoted individually; call 1-833-STEVIE-1.
